General Conditions of Sale

Article 1 : Application of the General Conditions of Sale

Any sale or order, contracted by means of the web site, is subject to the present general conditions of sale, that the customers may consult at any time by clicking on the link "general conditions of sale" and to which they agree without reserve. The seller is not bound by any declaration or any indication not mentioned on his web-site nor by any stipulation not expressly accepted by him. In case of a conflict between the present general conditions of sale and the buyers' general or specific conditions of purchase, the present general conditions of sale will take precedence and the customer will be obliged to respect them.

Article 2 : Taking of an order

The customer may place an order through this web-site, or else by letter, fax or telephone. In any case, the order is not considered to be definitive until the payment has been made by bank card via the secure server of the Société Générale, or until the cheque has been validated. The data registered on the Société Générale's site or the successful cashing of the cheque or postal order, are considered proof of payment.

Article 3 : Price

The prices of our items are indicated in euros and are to be paid for in this currency.The prices indicated for each article include VAT, but not the cost of carriage, which appears in the summing up of the order.
For any order outside France, the customer is considered to be the importer of the items concerned. For all items sent outside the European Union, the price will be calculated without customs duty or any taxes applicable, which will be paid by the customer, who consequently accepts the responsibility for the declaration of the goods and the payment of these duties and taxes.
The seller has a right to modify his prices at any time, items being billed on the basis of the price applicable at the time the order was definitively registered.

Article 4 : Delivery

The seller declines all responsability for items which are transported at the customer's own risk.It is the customer's resposibility to check that the contents of the package correspond with the delivery slip and, if necessary, give a written statement to the carrier, who alone is to be held responsible, until otherwise proven, and to inform the seller.

Article 5 : Payment

Payments are carried out by SSL, a secure system, by means of the following bank cards: Carte Bleue, Visa, Euro Card Master Card. Orders can also be paid by French bank account cheque or by postal order, made out to Carteland.
Unless otherwise indicated, a delivery note is sent to the delivery address with the order.

Article 6 : Exhange of items

The customer has a limit of eight days, after the delivery of his order, to send back an item which is not of satisfaction, and claim an exchange, sending a detailed letter of explanation. This is applicable only if all copies of the said article are returned, in their packaging, along with a copy of the bill and/or a delivery note.The delivery costs for returned items are to be paid by the customer. In this case the customer's statutory right to cancel the order does not apply. According to the article L 121-20-2 of the consumer's code, the right to cancel an order in the case of mail order, is not applicable, unless otherwise agreeed, for contracts concerning the supply of personalised articles, which by their very nature cannot be re-used and are susceptible to a rapid deterioration:
The customer's attention is drawn to the fact that the right to cancel is not therefore applicable to the sale of items personalised at his request.

Article 7 : Quality of the products

The products sold on the site CARTELAND are made according to certain criteria of quality, recognised by well-established printing firms.
It is purposefully stipulated that the reproduction of coloured items on the site, is not legally binding. Printed products can never reproduce exactly the same colours that appear on the screen of the customer's computer . Colours can look different, according to the computer's configuratiion and according to the quality of the screen and of the printer.
So the seller cannot be held responsible for a slight difference in shade between the product visualised on the screen and the delivered product.
It is likewise stipulated that the appearance of the paper's texture as seen on the site, is not legally binding. It is in fact impossible for the purchasers to get a true idea of the texture of the paper they have chosen, as this choice can only be made according to the appearance of the texture on the computer screen they use for placing their order. The appearance of texture can be different according to the computer's configuratiion and according to the quality of the screen and of the printer.
As a consequence the seller cannot be held responsible for a slight difference in texture between the product visualised on the screen and the delivered product.

Article 8 : Intellectual property

The designs, drawings, logos, photos, objects and pictures, proposed on the CARTELAND site for creating items, are protected by rights of intellectual property.
The purchaser recognises that items he orders may only be used for their designated purpose. Any other use of designs, drawings, logos, photos, objects and pictures, such as reproduction, sale, distribution, edition etc. is to be considered as forgery and therefore liable to be sanctioned.

Article 9 : Responsibility

The buyer alone is responsible for the content of the products created on the site. He therefore declares that he holds all the necessary rights for adding objects, pictures, photos, logos and drawings to the objects created and guarantees the seller that these rights are valid and conform to the present legislation and that the ordering and use of these products does not and will not infringe on the rights of a third party. The buyer also declares that the products created are not susceptible to be considered a forgery or to compromise a third party in any way and that the purchase and use of these products in general is not in breach of any existing law or legislation. The buyer therefore undertakes to compensate the seller in the case of any legal proceedings brought against him by a third party, who consider themselves prejudiced by the printing, broadcast or generally by the use of the objects ordered.

Article 10 : Law to be applied in the case of litigation

The present contract is governed by French law. In the case of any disputes,the Tribunal de Commerce of Aix-en-Provence will have non-exclusive jurisdiction.

Article 11 : Nominative information

The seller agrees not to divulge any information given to him by the buyer. It is to be used only for handling the order and for client follow-up. When the buyer goes onto another site, by clicking on a hypertext link, certain information may be communicated to this site. In accordance with the law of 6th January 1978 concerning computing and liberties, the buyer has a right to access, modify, rectify or delete his personal information.
